Introduction

Skyware® consists of (1) the public website (www.skywareinventory.com) and (2) the secure, user authenticated web application (hereinafter collectively referred to as Skyware or the Service).

Thank you for visiting, accessing and/or using Skyware which is owned and operated by Open Sky Software, Inc. (Open Sky or we or our or us). By visiting, accessing and/or using Skyware you agree to by bound by Skyware's Terms of Use which includes this Privacy Policy as well as Skyware's Cookie Policy herein incorporated by reference. This Privacy Policy explains how Open Sky collects and uses information from users of Skyware (Users).

Open Sky believes privacy and data protection are the right of all Users, and Open Sky will never sell, rent, or otherwise distribute or make public your data and information. Open Sky is committed to respecting the privacy and the confidentiality of all Users.

P.2 INFORMATION WE COLLECT

Information We Collect

When you access or use Skyware, we may gather and process some or all of the following information:

  • Log Information: We collect log information about your use of Skyware, including the type of browser you use, access times, pages viewed, your IP address, and your activities (clicks).

  • Device Information: We collect information about the computer or mobile device you use to access Skyware, including the hardware model, operating system and version, unique device identifiers, and mobile network information.

  • Registration Information: We collect registration information when you voluntarily register for use of the Service, including, but not limited to, company name, user names, phone numbers, passwords, postal addresses, and email addresses.

  • Your Skyware Service Data: We collect inventory-related information from Users of the Service, including, but not limited to inventory items, inventory transactions, documents, contact lists, and other data associated with the Service.

  • Customer Service Communications: We collect information reported to us by you, including, but not limited to, bug reports, feature requests, and technical support requests.

  • Audit Logs: Skyware collects information that helps us provide a better and more reliable service. This information includes audit logs that record basic information about your interactions with Skyware. These logs include the following information: timestamp of requests, session ID, IP address, request type, elapsed time of request, any error codes, and the browser/device user agent.

  • Payment Information: For payment transactions, we use third-party providers of payment services. These services will collect necessary credit card and payment processing information in order to process your payments. You are providing the necessary payment processing information directly to such provider(s) and not to Skyware.

  • Information Collected by Cookies and Other Tracking Technologies: We use various technologies to collect information, including technical cookies for session management, Google Adsense cookies for serving advertisements, Google Analytics tracking for compiling statistical (anonymized) data, and Google Recaptcha cookies to prevent malicious (spam) bots from adversely impacting Skyware. Personal Information

Any information that can uniquely identify an individual, such as (but not limited to) an individual’s name, email address, phone number and postal address is considered and treated as Personal Information (Personal Information) under this Policy. No Personal Information is gathered merely by visiting our public website. Personal Information is only collected when you register to use Skyware, when you contact us and/or when you otherwise provide Personal Information directly to us.

P.3 USE OF INFORMATION

We may use the information we collect to:

  • Improve Skyware and Service;
  • Troubleshoot problems;
  • Provide customer service you request;
  • Communicate with you about Skyware;
  • Post comments anonymously on Skyware;
  • Monitor and analyze usage trends and activities within Skyware;
  • Detect, investigate and prevent fraudulent transactions or other illegal activities;
  • Protect the rights, property and safety of Open Sky and enforce the Terms of Use;
  • Meet legal requirements and/or respond to lawful requests by public authorities; and
  • Provide advertisements.

No Sale of Personal Information

Open Sky will not sell, rent, trade, or otherwise transfer any information we collect to any third party without your explicit permission, unless we are obliged to do so under applicable laws or by order of public authorities. We store your Content (as defined in the Terms of Use) only to provide Skyware to you and at your direction, and do not disclose Content to third parties except when we reasonably believe we need to investigate, prevent or take action with respect to any potential or actual fraud, illegal activities, circumstances which threaten the physical safety of any person, violations of the Terms of Use or as otherwise required by law to comply with any judicial or governmental subpoenas, warrants or orders.

Lawful Basis for Processing

The following represents Open Sky’s lawful basis for processing your Personal Information:

  • To provide Skyware in accordance with the Terms of Use.
  • You have given valid consent when you accept the Terms of Use.
  • The information processed is the minimum necessary to provide Skyware and further Open Sky's legitimate interests (without overriding your rights or interests).

Third Party Data Processors and Services Provided

Skyware's third party providers have been carefully chosen and all of them comply with the legislation set out at the beginning of this Privacy Policy. These providers may use cookies and other technologies to collect information about your use of Skyware. This information may be used by Open Sky to analyze and track data, determine the popularity of certain features, deliver advertising on Skyware, and prevent malicious (spam) bots from adversely impacting Skyware. Retaining Your Information

Open Sky will retain your information only for as long as is necessary to:

  • Provide Skyware,
  • Comply with applicable regulatory requirements, requests and relevant orders from public authorities,
  • Enforce the Terms of Use, or
  • Fulfill any of the other purposed detailed in this Privacy Policy.

P.4 SECURITY

Physical Security

Our offices and servers are located in the United States in facilities with advanced security features, including, but not limited to: keycode and/or biometric security access, locked server cabinets, and intrusion monitoring systems. Your information will not be transferred, stored, or processed outside of these locations in the United States.

Staff Security

All of Open Sky’s staff are in-house, on-shore software developers and systems engineers who undergo comprehensive criminal background checks and agree to strict security and employment policies and practices.

Software, Communications and Data Security

We take appropriate and reasonable technical measures to protect all information we collect from loss, misuse, unauthorized access, disclosure, alteration, and destruction, including, but not limited to:

  • Security Firewalls (UTM Gateways) and Monitoring,
  • Encrypted HTTPS browser communication featuring Transport Layer Security (TLS),
  • Secure (and hashed) passwords that we cannot reverse engineer, and
  • Encrypted Personal Information within the database.

Despite Open Sky’s efforts and commitment to keep information and data secure, we cannot guarantee that data transmitted over the Internet or any other public network is 100% secure. We are not responsible for circumvention of any privacy settings or security measures on Skyware or Service. Any transmission of Personal Information is at your own risk.

P.5 DATA BREACHES

We will report any unlawful data breach of Skyware (or any disclosed unlawful data breach of our third party data providers) to you and relevant authorities within 72 hours of the breach if it is apparent that Personal Information stored in an identifiable manner has been stolen.

P.6 USER RIGHTS

If you have submitted Personal Information to us in accordance with the provisioning of Skyware under the Terms of Use, then you have the right to:

  • View, change or limit your Personal Information,
  • Delete your Personal Information,
  • Request limits in the manner we use and process your Personal Information,
  • Object to the manner we use and process your Personal Information,
  • Withdraw your consent for the use and processing of your Personal Information,
  • Request your Personal Information in a portable format, and
  • Opt-out of email communications.

Upon request and verification of your identity as a User of Skyware, Open Sky will attempt to quickly fulfill your requests. Please contact us per the Contact Section below to exercise these rights.

P.7 MISCELLANEOUS

Children

If you are under 16 years of age you MUST obtain parental consent before using Skyware. Open Sky does not knowingly collect Personal Information and data from children under the age of 16 without parental consent. In the event Open Sky determines information has been collected without parental consent, that information will be deleted as quickly as possible or the child’s parent or guardian will be contacted for consent.

Do Not Track (DNT)

Skyware does not currently respond to Do Not Track (DNT) signals.

How far does our responsibility extend?

This privacy policy applies solely to data collected and managed by Skyware. Open Sky does not exercise control over nor do we accept responsibility or liability for other users of Skyware or users of other websites.

Open Sky may change this privacy policy at any time and from time to time. The most recent version is reflected by the version date at the top of this policy. All updates and amendments are effective immediately upon notice, which we may provided to you by email, notice through Skyware, and/or by updating the version date located on this page. We encourage you to review this Privacy Policy whenever you access Skyware.
